Servers at Milos Restaurant in Miami have alleged in a federal court lawsuit that they were not paid minimum wage and overtime in violation of the Fair Labor Standards Act (“FLSA”). The workers’ FLSA lawsuit claims that Milos did not allow the restaurant’s waiters and busboys to retain all of their tips and required the servers to pay a portion of their tips to non-tipped employees. The wage lawsuit also claims that servers were not paid the applicable minimum wage for regular hours worked, were not paid overtime, and were forced to perform side work (while not earning tips) in excess of 20% of their work time. Lawyers for the waiters are seeking unpaid overtime compensation, unpaid minimum wage compensation, liquidated damages, and attorneys’ fees.
