Maggiano’s Little Italy, a chain restaurant owned by Brinker International, Inc. has settled a tip and gratuity misappropriation case at its Boston, Massachusetts location for 1.3 million dollars. According to a Maggiano's Settlement Agreement filed in the United States District Court for the District of Massachusetts, the restaurant illegally charged customers a gratuity/service charge during private dining events but did not give the full proceeds of that gratuity/service charge to its waiters and waitresses. The settlement agreement resolves the claims of the waitstaff at the Boston location of Maggiano’s Little Italy restaurant. The case will continue to be litigated, however, in regard to the claims of the nation-wide class action against the restaurant chain.
