Le Bernadin, recently named by Zagat in its 2013 Survey as having the best food of any restaurant in New York, has been sued again for wage theft. According to a class action Complaint filed on September 27 in Manhattan federal court by a former waiter at the restaurant, Le Bernadin illegally retained portions of the waitstaff’s tips. Attorneys for the employees claim that the waiter and waitresses were required to share tips with managers, a wine director and a “coffee guy” who worked exclusively in the kitchen preparing coffee. This is the second time Le Bernadin has been sued for violating waiters’ rights at its restaurant. The previous lawsuit which was filed in 2011 was resolved by the parties and dismissed on August 12, 2012. Lawyers for the workers seek back wages, liquidated damages, and attorney’s fees.
