Tom’s Restaurant, the hangout of Jerry Seinfeld and his friends on the Seinfeld television show, was hit with a lawsuit for unpaid wages and overtime by a former waiter.

The lawsuit filed by waiter Eduardo Hernandez in Manhattan federal district court claims that he worked 50 hours per week but was only paid $20 per shift and was not paid any overtime for hours worked over 40 in a week.  Hernandez also claims he never received “spread of hours” pay, which entitles minimum wage workers in New York to receive an extra hour of pay at minimum wage if their workday spans over 10 hours.
