Philippe restaurants on Long Island and Manhattan have been hit with a class action lawsuit by servers and bartenders who complain that they have been denied minimum wage and overtime pay and that the restaurants improperly took a tip credit under the Fair Labor Standards Act (“FLSA”).  The lawsuit claims that managers at the restaurant unlawfully received tips from the tip pool and that the restaurant also made illegal deductions from gratuities and failed to pay spread of hours pay required by the New York Labor Law.
