Juquila, a Mexican restaurant in Elmhurst, Queens, has been ordered to pay $335,728.26 in back pay and damages to five former servers for unpaid wages and discrimination violations.  Federal Court Magistrate Judge Reyes held that the restaurant failed to pay proper minimum and overtime wages to the servers and also violated the Equal Pay Act by paying male servers more than female servers who worked in the restaurant.  The workers who sued the restaurant were paid $4.50 per hour for all hours worked, including hours over 40 per week.  The decision follows an inquest at which the employees gave sworn testimony about their weekly schedules and payments from Juquila.  Juquila is ordered to pay $335,728.26 which includes wage and Equal Pay Act damages, liquidated damages, and interest.
