Assistant Manager Trainees at McDonald’s will share in a $2,422,850 settlement of an overtime lawsuit which was approved on November 9, 2010 by Leonard P. Stark, United States District Judge for the District of Delaware.  Pursuant to the Court’s Order, over 2,200 current and former employees are eligible to participate in this settlement under the Fair Labor Standards Act (“FLSA”).

The settlement of this case, Justison v. McDonald's Corporation, 08 Civ. 0448 (LPS) provides that Assistant Manager Trainees who worked between February 2006 and July 2010 will receive overtime back pay in amounts ranging from a minimum of $675 to a maximum of $1,100.  The assistant managers in this case alleged that they were not paid overtime when they were working at McDonald’s in positions that were “non-exempt” from overtime under the FLSA.
